Terms of Service

What this is

achoo.fyi (the "Service") is a personal SMS notification project operated by Matthew Hemby, a sole proprietor in Austin, Texas. The Service sends you one daily SMS recommending an over-the-counter antihistamine from a list you select, based on local pollen conditions.

Not medical advice

The Service is not medical advice. Recommendations are generated by an automated rule based on public pollen data and the over-the-counter medications you have indicated you already take. The Service does not know your medical history, drug allergies, current medications, or contraindications. Always consult a licensed healthcare provider before starting, changing, or stopping any medication. Never take medication that has not been approved for you by a healthcare provider, and always follow the dosage instructions on the medication packaging.

The Service only references a list of common over-the-counter antihistamines. It does not recommend prescription medications. You are solely responsible for your medication decisions.

Eligibility

You must be 18 or older to use the Service.

How it works

You sign up by providing your phone number and verifying ownership via SMS one-time password. You select which OTC antihistamines from our defined list you already take. You explicitly consent to receive one daily SMS. You can unsubscribe at any time by replying STOP to any message, or by visiting achoo.fyi and completing phone verification.

SMS terms

By signing up, you consent to receive one (1) SMS message per day from achoo.fyi. Message and data rates may apply. Reply STOP, UNSUBSCRIBE, CANCEL, QUIT, or END to any message to opt out. Reply HELP for help.

Your responsibilities

Provide accurate information.
Only sign up with a phone number you personally own.
Do not sign up other people.
Do not abuse, reverse-engineer, or attempt to disrupt the Service.

Service availability

This is a personal project offered "as is" with no guarantees. The Service may:

Have outages, bugs, or incorrect recommendations.
Pause, change, or terminate at any time without notice.
Be discontinued entirely at the operator's discretion.

No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE OPERATOR DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO HEALTH OUTCOMES, MEDICATION DECISIONS, OR SERVICE OUTAGES.

Termination

Either party may end this agreement at any time. To terminate, reply STOP to any SMS or visit achoo.fyi to unsubscribe.

Governing law

These Terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved in the state or federal courts located in Travis County, Texas.

Changes

We may update these Terms. Material changes will be announced via SMS to active users.
